Following on from numerous diplomatic interventions, the USA has now sought to justify its “blockade” by presenting a detailed report criticizing the substance of the Appellate Body’s work[1]. The leitmotif of the American criticism is the argument that the Appellate Body lacks sufficient legitimacy to perform its functions: that its rulings to develop WTO law are carried out in a way that no longer conforms to the will of the contracting parties. As a result, the rulings of the Appellate Body exceeded their authority as set down in, for example, Art. 17 DSU.
